Terms and Conditions​

By booking, purchasing, or receiving services from Spa Day With Gwen (“Company,” “we,” “us,” or “our”), you (“Client,” “you”) agree to the following Terms & Conditions.

Services Provided

Spa Day With Gwen provides professional massage therapy and esthetic services, including facials/skin care services, performed at the client’s residence or designated location within the State of Texas.

All services are therapeutic and cosmetic only and strictly non-sexual. Any inappropriate behavior, requests, comments, or advances will result in immediate termination of the session without refund and may be reported to law enforcement and/or the Texas Department of Licensing & Regulation (TDLR).

 

Texas Licensing Disclosure

All services are provided in compliance with Texas Department of Licensing & Regulation (TDLR) laws and rules.

  • Massage therapy services are performed by a Licensed Massage Therapist (LMT)

  • Esthetic services are performed by a Licensed Esthetician

Remote / In-Home Service Compliance

When services are provided at a client’s location.

  • Only TDLR-approved, non-invasive esthetic/ massage techniques used 

  • All products and procedures comply with Texas sanitation and safety standards and professional conduct rules

  • Services may be modified or refused if conditions are unsafe, contraindicated or fall outside legal scope

Spa Day With Gwen reserves the right to decline any request that exceeds the legal esthetic/massage scope defined by TDLR.

Client Acknowledgment

By booking and receiving esthetic/massage services, the client acknowledges that:

  • They understand the cosmetic nature of esthetic services 

  • They have disclosed all relevant medical conditions and contraindications

  • They agree not to request services outside the service provider's legal scope

Scope of Massage Therapy Services

All massage therapy services provided by Spa Day With Gwen are performed by a Texas Licensed Massage Therapist (LMT) and are limited to the scope of practice permitted under the Texas Department of Licensing & Regulation (TDLR) and the Texas Occupations Code, Chapter 455.

Massage therapy services may include:

  • Manual manipulation of soft tissues, including muscles and connective tissue

  • Swedish massage, relaxation massage, and therapeutic techniques

  • Stretching and range-of-motion techniques within client comfort

  • Application of massage lotions, creams, or oils

  • Techniques intended to promote relaxation, reduce muscle tension, and support general wellness

All massage services are therapeutic and non-sexual in nature.

Scope of Esthetic Services

All esthetic (facial and skin care) services provided by Spa Day With Gwen are performed by a Texas Licensed Esthetician and are limited strictly to the scope of practice permitted by the Texas Department of Licensing & Regulation (TDLR).

Esthetic services may include:

  • Beautifying a person's face, neck, or arms using, antiseptic, tonic, lotion, powder, oil, clay, or cream

  • Manual exfoliation using approved cosmetic products

  • Application of cosmetic-grade products and masks

  • Facial massage included

  • Non-invasive skin care treatments 

 

Client Eligibility

Clients must be 18 years of age or older. Minors may receive services only with written parental or legal guardian consent, and a guardian must be present during the entire session, as required by Texas regulations.

 Health Disclosure & Client Responsibility

Clients must disclose all relevant health information prior to treatment, including but not limited to:

  • Medical conditions or injuries

  • Pregnancy

  • Allergies or skin sensitivities

  • Recent procedures or surgeries

  • Medications affecting the skin or circulation

Services do not include and are not a substitute for:

  • Medical diagnosis, treatment, or prescription

  • Chiropractic, physical therapy, dermatological services

  • Treatment of fractures, open wounds, infections, or acute inflammation

  • Any service requiring a medical license

  • Service provider does not diagnose medical conditions. Clients experiencing pain, injury, or medical concerns should consult a licensed medical professional.

Failure to disclose accurate information releases Spa Day With Gwen from liability related to adverse reactions or outcomes.

We reserve the right to refuse, modify, or discontinue services if a condition is contraindicated under Texas licensing rules.

Booking & Payment

  • Payment is due before or at the time of service  ​

  • Prices and services are subject to change without notice

  • Travel or convenience fees may be applied

Cancellation & No-Show Policy

As of February 10, 2026, no cancellation fee will be charged for cancellations made due to the client’s reason within short notice. This policy is subject to change in the future.

  • To respect the therapist’s time, clients are kindly asked to provide at least 24 hours’ notice for any cancellations or rescheduling.

Late start time due to client's reason may result in a change of date or time adjustment.

In-Home Service Environment

Clients are responsible for providing:

  • A clean, safe, and sanitary environment

  • Adequate space for a massage table or facial setup

  • Reasonable lighting, ventilation, and temperature

  • Pets secured away from the service area

If conditions are unsafe, unsanitary, or inappropriate, services may be canceled with Refund.

Right to Refuse or Terminate Services

We reserve the right to refuse or end a session immediately for:

  • Inappropriate conduct

  • Intoxication or illegal substances

  • Unsafe environments

  • Health contraindications

  • Harassment or boundary violations

No refunds will be issued if services are terminated for these reasons.

Assumption of Risk & Liability Waiver

Clients acknowledge that massage/esthetic services involve inherent risks, including but not limited to soreness, redness, or temporary skin reactions.

By receiving services, you voluntarily assume all risks and agree that Spa Day With Gwen and its practitioners are not liable for:

  • Injuries or reactions resulting from treatments

  • Outcomes not meeting personal expectations

  • Failure to follow pre- or post-care instructions

Services are not a substitute for medical care.

 Results Disclaimer

Individual results vary. No guarantees are made regarding outcomes from massage therapy or esthetic services.

Privacy & Confidentiality

Client information is handled in accordance with our Privacy Policy and Texas privacy standards.

Governing Law

These Terms & Conditions are governed by the laws of the State of Texas.
